📜 Cancellation and Refund Policy (سياسة الإلغاء والاسترجاع)

1. Scope of the Policy (نطاق السياسة)

This policy applies to all accommodation and related service bookings made through:

  • The Website or Mobile Application.

  • Telephone Bookings.

  • Direct Attendance (Walk-ins).

  • Bookings made through Approved Intermediaries.

Completing a reservation constitutes explicit acceptance of all terms and conditions contained within this policy.


2. Transparency and Disclosure (الشفافية والإفصاح)

The establishment is committed to clearly displaying room rates, fees, taxes, and cancellation/refund policies before the payment process is finalized, in compliance with the Consumer Protection Law in the Kingdom of Saudi Arabia (KSA).


3. How to Cancel or Modify via the Platform (كيفية الإلغاء أو التعديل عبر المنصة)

Guests can contact Customer Service to cancel or modify a reservation at any time.

  • Cancellation and modification policies vary by hotel and room type. Some rates may be Non-Cancellable or Non-Refundable.

  • The specific cancellation policy for each room is clearly displayed on the booking page under the "Terms" section.


4. General Cancellation Policy (سياسة الإلغاء العامة)

4.1. Free Cancellation (الإلغاء بدون رسوم)

A reservation can be cancelled free of charge if the cancellation is made at least 72 hours prior to the arrival date.

4.2. Cancellation with Fees (الإلغاء برسوم)

If the cancellation is made less than 72 hours before the arrival date, a cancellation fee equivalent to the value of one night's stay or a specified percentage, depending on the booking type, will be deducted.

4.3. No-Show Policy (عدم الحضور)

No-Show fees are applied according to the specific hotel's policy, which varies from one property to another and usually includes one of the following options:

  • Deduction of the one night's value.

  • Deduction of the full booking amount.

  • Any other policy specified by the hotel and displayed during the booking process.

Fees are applied as announced by the hotel on the room or offer page.


5. Non-Refundable Rates (الأسعار غير القابلة للاسترجاع)

Some promotional rates are non-cancellable and non-refundable. Completing the payment for such rates is considered acceptance of not claiming the amount later.


6. Reservation Modifications (التعديلات على الحجز)

  • Reservations can be modified subject to room availability and provided they do not conflict with the original price terms.

  • Price differences may apply when changing dates.

  • Non-refundable bookings cannot be modified unless the offer explicitly states otherwise.


7. Refunds (استرداد المبالغ)

7.1. Refund Method (طريقة الاسترجاع)

Refunds will be issued to the same payment method used for the original booking.

7.2. Refund Duration (مدة الاسترجاع)

  • Processing takes 7 – 14 business days.

  • The appearance of the amount in the guest's account depends on the issuing bank.


8. Force Majeure Events (حالات القوة القاهرة)

In the event of circumstances preventing the provision of the service (official closure, disasters, major breakdowns):

  • Full refund of the amount, or

  • Provision of an equivalent alternative, or

  • Issuance of a credit (voucher) of the same value.


9. Cancellation by the Establishment (إلغاء الحجز من قِبل المنشأة)

A reservation may be cancelled for exceptional reasons such as:

  • Technical error leading to a wrongful confirmation.

  • Maintenance or safety issues.

  • Guest's failure to adhere to the accommodation terms.

In such cases, the guest will be compensated or the full amount will be refunded.


10. Tax Regulations upon Booking (الضوابط الضريبية عند الحجز)

  • Some hotels include the Value Added Tax (VAT) within the booking price, and it is collected electronically through the platform.

  • Some hotels require the tax to be paid in cash upon arrival, separately from the booking value.

  • The platform is committed to displaying the tax calculation method as provided by the hotel, and the establishment is responsible for the accuracy of its tax data.


11. Guest Identification Proof (إثبات هوية الضيف)

The guest is obligated to present a valid ID (National ID/Iqama/Passport). Failure to present the ID grants the establishment the right to refuse entry without compensation.


12. Technical Errors and Incomplete Bookings (الأخطاء التقنية والحجوزات غير المكتملة)

In the event of an incorrect price display or a technical error leading to an incomplete booking: The platform reserves the right to cancel the reservation and fully refund the amount without any additional obligation.


13. Additional Fees and Taxes within the Property (الرسوم الإضافية والضرائب داخل المنشأة)

The property may impose additional fees such as:

  • Extra bed charges.

  • Tourist fees.

  • Special services within the hotel.

These fees, if any, will be displayed during the booking process or upon arrival.


14. Platform's Role as Intermediary (دور المنصة كوسيط)

The platform's role is limited to displaying and confirming reservations only. The responsibility for the quality of service and facilities rests directly with the hotel.


15. Mechanism for Requesting Cancellation or Refund (آلية طلب الإلغاء أو الاسترجاع)

The request must include: Booking Number – Guest Name – Arrival Date – Payment Method.


16. General Provisions (أحكام عامة)

  • In case of any discrepancy between the Arabic and English versions, the Arabic text shall prevail.

  • Disputes shall be handled in accordance with the regulations applicable in the Kingdom of Saudi Arabia.

Despite these measures, absolute protection cannot be guaranteed due to the nature of the internet, and we exert maximum possible efforts.

  • Any third-party claim due to your misuse of the platform or violation of laws.

Second: Limitation of Liability (تحديد المسؤولية)

To the extent permitted by law, Jawharat Al Mukhtar, its employees, or partners will not be liable for any direct or indirect damages, including:

  • Loss of profits or revenue.

  • Loss of opportunities.

  • Damages resulting from service interruption or website errors.

In all cases, the maximum liability of the platform is limited to the value of the paid service or 1000 Saudi Riyals, whichever is lower.

Third: Exceptions (استثناءات)

This limitation does not include any liabilities that cannot be restricted under the applicable regulations in the Kingdom of Saudi Arabia.
